1. Scope and parties
These Terms and Conditions ("Terms") govern your use of the mobile application Dashcam, the website at dashcam.berlin and all related services (together, the "Service") provided by Another Network GmbH, Reichenberger Straße 61, 10999 Berlin, Germany ("we", "us", "our").
A contract between you and us is concluded when you create an account and accept these Terms. The Service is provided free of charge. We do not currently charge any fees.
Our Privacy Policy explains how we handle personal data and forms an integral part of these Terms.
2. Eligibility
You must be at least 16 years old to use the Service. By creating an account you confirm that you meet this requirement.
If we become aware that a user is under 16, we will close the account and delete the associated data.
You may only use the Service if you are legally permitted to do so under the law applicable to you.
3. Account and sign-in
You sign in using a one-time code sent to your phone number or using Sign in with Apple. We do not store passwords.
You are responsible for keeping access to your account secure, including access to the phone number or account used to sign in. Please notify us without delay if you believe someone else has gained access to your account.
You may hold only one account unless we expressly permit otherwise. Accounts are personal and may not be transferred or shared.
4. What the Service does
The Service invites you at intervals to record a short video clip (a "Clip"). You choose whether to record a Clip and with whom to share it: with one or more groups you have joined or created (each a "Group"), or on your own timeline.
Clips shared within a Group are visible to the other members of that Group. Clips shared on your own timeline are visible to the users you have connected with, for a limited period.
The Service automatically combines the Clips shared within a Group, or on your own timeline, over a given period into a single compilation video (an "Artefact"). This means an Artefact for a Group will contain Clips recorded by other members, and your Clips will appear in the Artefacts of the Groups you share them with. This is the central purpose of the Service.
You can save an Artefact to your device or share it through other applications and platforms. Section 7 sets out the rules that apply when you do.
We may add, change or discontinue features of the Service. Where a change materially reduces the functionality available to you, we will inform you in advance in an appropriate manner.
5. Your content and the licence you grant us
You retain all rights in the content you create and share on the Service.
To operate the Service, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable and transferable licence to store, reproduce, adapt, format, technically process and display your content, and to combine it with the content of other users into Artefacts, in each case solely for the purpose of providing, securing and improving the Service.
The licence ends when you delete the relevant content or your account, except that (a) copies retained in backup systems expire in the ordinary course of backup rotation, and (b) we cannot recall Artefacts that other users have already saved to their own devices or shared outside the Service.
We do not use your content for advertising and we do not sell it.
You warrant that you hold all rights necessary to share the content you upload and that it does not infringe the rights of third parties.
6. Content showing other people
Where your Clips show other people, you are responsible for having the necessary permission to record and share them. In Germany this follows in particular from the right to one's own image under sections 22 and 23 of the Kunsturhebergesetz.
If you appear in another user's Clip and object to it, you can report the Clip in the Application. We will review the report in accordance with section 9.
7. Artefacts and export
When you save or share an Artefact outside the Service, the Artefact leaves our systems and our control. From that moment you are the person deciding on its further distribution.
You therefore agree that you will only export or share an Artefact if you are entitled to distribute the content it contains, including any Clips recorded by other members of the Group.
We are not able to withdraw or delete content that you or another user has already exported or published elsewhere.
If you no longer want your Clips to appear in Artefacts, you can delete the relevant Clips or leave the Group. Artefacts generated before that point are not affected retroactively.
8. Community Guidelines: prohibited content and conduct
These Community Guidelines form part of these Terms and define what is not allowed on the Service. They apply to Clips, Artefacts, profile information, group names, comments and any other content or conduct on the Service.
8.1 Absolutely prohibited
Child sexual abuse and exploitation (CSAE). We have zero tolerance for any content or conduct that sexually exploits, abuses or endangers children. This includes child sexual abuse material (CSAM), sexualised depictions of minors whether real or generated, grooming, sexual solicitation of a minor, sextortion, and the trading of or linking to such material. Violations lead to immediate removal of the content, irreversible termination of the account and a report to the competent authorities.
Content depicting or promoting terrorism, violent extremism, or the glorification of mass violence.
Non-consensual intimate imagery, and threats to distribute intimate imagery.
Content that incites or threatens serious violence against a person or a group.
Human trafficking, the sale of illegal goods, and the sale of regulated goods to persons not permitted to acquire them.
8.2 Not allowed
Pornographic or sexually explicit content.
Hate speech, that is, attacks on people on the basis of ethnicity, national origin, religion, disability, age, sex, sexual orientation or gender identity.
Harassment, bullying, stalking, doxxing or the repeated unwanted contacting of another person.
Graphic violence, gore, and content depicting cruelty to people or animals.
Content that encourages self-harm, suicide or disordered eating.
Impersonating another person or organisation, or misrepresenting your identity in a way that misleads others.
Content that infringes the copyright, trade mark or personality rights of others.
Spam, deceptive engagement practices, and commercial solicitation without our prior written consent.
Recording other people in situations where they have a reasonable expectation of privacy, such as bathrooms, changing rooms or medical settings.
8.3 Technical conduct
Do not attempt to gain unauthorised access to the Service, other accounts or our systems.
Do not scrape, crawl or bulk-download content, and do not use automated means to interact with the Service.
Do not reverse engineer, decompile or interfere with the Service, except to the extent this is permitted by mandatory law.
Do not circumvent access restrictions, rate limits, moderation measures or account suspensions.
9. Reporting content and how we moderate
9.1 How to report
Every Clip, Artefact, profile and Group in the Application has a report function. You can also report content or conduct by email to admin@anothersocial.media.
A report should identify the content or account concerned, explain why you believe it is unlawful or violates these Terms, and give us a way to contact you if we need more information. You may report anonymously, but this may limit our ability to inform you of the outcome.
9.2 What we do with a report
We review reports without undue delay and in a diligent, non-arbitrary and objective manner. Depending on the outcome we may:
- take no action, where the content does not violate these Terms or the law
- remove or restrict access to the content
- limit the visibility of the content
- issue a warning to the account holder
- suspend the account temporarily
- terminate the account permanently
- report the matter to the competent authorities where we are required or entitled to do so.
Reports concerning child safety, credible threats of violence or an acute risk to life are prioritised over all other reports.
9.3 Information about our decisions
If we remove your content or restrict your account, we will inform you of the decision, the reason for it, the legal or contractual basis we relied on, whether automated means were used, and how you can object.
9.4 Objecting to a decision
If you believe a decision was wrong, you can object by writing to admin@anothersocial.media. We will review the objection and inform you of the result. If the objection is justified, we reinstate the content or the account.
This does not affect your right to bring the matter before a court or a competent out-of-court dispute settlement body.
9.5 Authorities
Orders and information requests from competent authorities can be sent to admin@anothersocial.media. We will act on them in accordance with applicable law and inform the authority of the action taken.
10. Suspension and termination by us
We may warn you, restrict your access, suspend or terminate your account if you materially or repeatedly breach these Terms, if your use of the Service creates a legal risk for us or other users, or if we are legally required to do so.
In the case of content falling under section 8.1, we will act immediately and without prior warning.
Our right to terminate for good cause remains unaffected.
11. Availability
We aim to keep the Service available, but we do not owe any particular level of availability. Maintenance, technical faults, and circumstances outside our control may lead to interruptions. We will announce planned maintenance in an appropriate manner where reasonably possible.
The Service depends on your device, your operating system version and your network connection. We do not guarantee compatibility with every device.
12. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and where liability is mandatory under the German Product Liability Act.
In the case of slight negligence, we are liable only for breach of an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely. In that case our liability is limited to the damage that is foreseeable and typical for this type of contract.
Any further liability is excluded.
We are not liable for content created by users, for the conduct of users towards one another, or for the use that a user makes of an Artefact after exporting it.
These limitations also apply in favour of our employees, representatives and vicarious agents.
13. Your right to end the contract
You may stop using the Service and delete your account at any time and without giving reasons. You can do this in the Application under Settings, or by submitting a request at https://dashcam.berlin/account-deletion.
Deletion of your account terminates this contract. The consequences for your data are described in our Privacy Policy.
14. Changes to these Terms
We may amend these Terms where this is necessary to reflect changes in the Service, in the law, or in case law, or to close a gap that has become apparent.
We will notify you of material changes at least 30 days before they take effect, in the Application or by the contact details you provided. If you do not agree, you may delete your account before the changes take effect. If you continue to use the Service after that date, the amended Terms apply.
15. Governing law and jurisdiction
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer with your habitual residence in another state, this choice of law does not deprive you of the protection of the mandatory provisions of the law of that state.
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Berlin, Germany.
16. Severability
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected.
